Many breathed a sigh of relief when the change of administration stalled efforts to change the long-established overtime classifications. The previous proposal sought to cover 4.2 million employees under the OT provisions of the Fair Labor Standards Act. https://www.dol.gov/sites/default/files/overtime-overview.pdf
The recently released proposal has provisions similar to those introduced earlier, however, does have caveats which could be both a boost for employees and not burdensome for employers. Time will tell what if any movement happens with this new proposal however employers will want to be proactive in looking at their job descriptions, compensation plans, and auditing job duties to ensure compliance with any final rule changes.Â
